How Delaware Homebuilders Split or Credit the 4% Transfer Tax on New Construction — Hen & Harbor
Updated October 2026
A Delaware builder offering $15,000 toward closing costs may still require the buyer to pay both sides of the transfer tax. On a $450,000 taxable purchase, the full 4.0% tax is $18,000. The incentive’s value depends on the contract’s starting allocation, not just the number printed in the advertisement.
Identify who owes each share
Delaware’s combined realty transfer tax consists of 2.5% state tax and 1.5% county or municipal tax. Resale contracts commonly divide the total into 2.0% buyer and 2.0% seller shares. New-construction contracts can allocate the expense differently, including assigning the full amount to the buyer.
| $450,000 taxable purchase | Transfer-tax amount |
|---|---|
| Combined 4.0% tax | $18,000 |
| Customary 2.0% buyer allocation | $9,000 |
| Maximum qualifying first-time-buyer reduction | $3,000 |
The first-time-buyer reduction equals 0.75% on up to $400,000 of purchase price and reduces the eligible buyer’s state share. Do not assume it reduces a contractually shifted seller obligation too. Confirm the calculation with the closing attorney and the Delaware Division of Revenue.
Translate the incentive into a closing worksheet
Ask the builder to show transfer tax, lender charges, title expenses, prepaid insurance and any rate incentive separately. A credit conditioned on using an affiliated lender should be compared against an independent lender’s rate and total costs.
Key questions include:
- Is the credit additional to the builder’s agreed tax payment?
- Can it cover eligible prepaid expenses or a temporary buydown?
- Does using it require a particular lender or settlement provider?
- What happens if available eligible costs are below the advertised credit?
Lender concession limits still apply. Lot purchases followed by separate construction contracts also need careful tax treatment; do not assume splitting paperwork automatically removes construction value from the taxable transaction.
Budget for the completed home
An initial tax bill may reflect land rather than the finished house. With countywide reassessments in New Castle, Kent and Sussex, request an estimate based on the completed property and applicable rates. Delaware’s relatively low annual property taxes can still produce an escrow shortage when the opening estimate is understated.
Delaware requires a Delaware-licensed attorney closing. Use Hen & Harbor’s closing cost estimator and compare the seller-assist framework before signing. The Consumer Financial Protection Bureau provides tools for comparing lender disclosures and spotting which incentives actually lower your cash requirement.

Rate comparisons use participating lender feeds, not a whole-market survey or guaranteed offers. Freddie Mac PMMS is a market benchmark, not a personalized quote. Calculator models rely on published regulatory formulas and disclosed assumptions rather than fabricated first-person loan testing.
Monthly principal and interest use the amortization formula P × r / (1 − (1 + r)−n), where r is the monthly note rate and n is the number of payments; at zero interest use P / n. PITI adds monthly property taxes and homeowners insurance; PMI is separate. APR includes applicable finance charges under Regulation Z and is not the note rate used for payments.
